Product-performance evidence must be combined with risk analysis, technical documentation, traceability, instructions, economic-operator information and corrective-action processes under the GPSR.

02 · UNITED STATES

Build the US File Around 16 CFR Part 1239.

Current 16 CFR part 1239 incorporates ASTM F1004-25 for gates and enclosures manufactured after 19 July 2026. A report to an earlier or later edition must be evaluated against the product manufacturing date, exact sample scope and the applicable mandatory rule.

EN 1930:2011 is the European child safety barrier standard referenced for this product category, but an EN report alone is not a complete EU approval file. Regulation (EU) 2023/988 applies from 13 December 2024 and adds business, documentation, traceability and post-market duties.

Risk & technical file

Document the internal risk analysis, applicable requirements, product description, essential characteristics and supporting evidence; keep required records current and available.

Identity & traceability

Provide product identifiers, manufacturer details and the EU responsible person or other applicable economic-operator information.

CE marking is not automatic

CE marking is required only when specific EU legislation covering the final product requires it. An ordinary manual baby gate should not be presented as “CE certified” merely because EN 1930 or the GPSR is relevant. Special electrical, connected or otherwise regulated configurations require a separate applicability review.
